Using the Finechef Platform

By accessing or using the Finechef website or mobile applications, you agree to these Terms and Conditions. We expect all users to provide accurate information when creating an account, placing orders, or communicating with our team. Finechef operates in line with Kenyan laws governing consumer protection, privacy, and online commerce

Definitions

To ensure clarity throughout these Terms:

  1. “Finechef” refers to our website, mobile applications, and all related digital services.
  2. “Customer” means any individual or business using Finechef to browse, order, or communicate with our team.
  3. “Vendor” refers to third-party sellers who list products on the Finechef marketplace.
  4. “Courier / Delivery Partner” means any independent delivery agent or company responsible for transporting orders.
  5. “Platform” refers to all digital environments and systems operated by Finechef.
  6. “Order” means a confirmed purchase made through the Finechef platform.

Your Account

You are responsible for securing your login details and notifying us immediately if you suspect unauthorized access. Personal information is handled in accordance with the Data Protection Act, 2019, and our Privacy Policy.

Communication and Order Placement

To protect both customers and vendors, all communication regarding orders, payments, delivery arrangements, inquiries, and complaints must remain within the official Finechef platform.

This includes:

  1. Your Finechef account
  2. In-app notifications
  3. Our verified SMS updates
  4. Official support channels

Finechef is not responsible for:

  1. Orders placed outside the platform
  2. Payments sent to unverified individuals
  3. Instructions or discussions held privately with riders, vendors, or third parties
  4. Any loss or issue resulting from off-platform communication

For your safety, avoid sharing personal or payment details through social media, private calls, WhatsApp chats, or other informal channels.

All valid orders, updates, and requests must be made through the Finechef website, app, or verified support contacts.

Product Information & Pricing Transparency

We strive to provide accurate descriptions, images, pricing, and availability for all our products. Before checkout, Finechef displays all known charges transparently, as required under the Consumer Protection Act. If a pricing or stock error occurs, we will contact you before processing or adjusting your order.

Purchases and Payments

All online purchases made through Finechef are valid remote agreements under Kenyan law. Once an order is placed, you enter a binding transaction with either Finechef or the relevant vendor.

Payments must be completed using the secure methods provided. Your rights regarding cancellations, returns, and refunds are fully covered in our dedicated policies, which form part of these Terms.

Shipping and Delivery

Finechef uses independent third-party couriers to deliver orders. Because delivery fees depend on the courier’s assessment of the parcel’s weight, size, distance, and delivery conditions, we cannot display delivery charges at checkout. For this reason, delivery fees will temporarily show as “0.00” or "0" during checkout. This does not mean delivery is free. Delivery fees are:

  1. Quoted by the courier once the order is packed,
  2. Paid directly to the courier or Paid to Finechef, who forwards the payment on your behalf.

All delivery fees and courier charges are the customer's responsibility. Once a package is handed to the courier, responsibility for the shipment transfers to the customer. Finechef may still assist in tracking and resolving delivery concerns whenever possible. Full delivery details are provided in our Shipping Policy.

Quality of Goods & Customer Rights

In line with Article 46 of the Constitution of Kenya and the Consumer Protection Act, you have the right to receive goods of reasonable quality. If a product is defective, damaged, or not as described, our Return and Refund Policies outline your options and the steps to follow.

Vendor Products

Some items are supplied by third-party vendors. These products follow the vendor’s individual return and refund guidelines. Finechef facilitates communication but cannot override vendor decisions or guarantee vendor-specific timelines.

Marketing, Promotions & External Links

Finechef may display promotional banners or links to external sites. Once you leave the Finechef platform, we are not responsible for third-party content or transactions.

Prohibited Activities

You may not:

  1. Use the platform for fraudulent transactions
  2. Misuse discount codes or promotions
  3. Attempt to manipulate vendor listings or systems
  4. Scrape, harvest, or duplicate content
  5. Interfere with the platform’s operations in any way

Finechef reserves the right to suspend accounts linked to any misuse.

System Availability & Maintenance

Finechef aims to provide uninterrupted access to our services. However, the platform may occasionally experience downtime due to maintenance, updates, or technical issues. We cannot guarantee continuous, error-free access; however, we will always work to restore the service as quickly as possible. Finechef is not responsible for losses resulting from temporary unavailability.

Fair Marketing & Product Representation

Finechef adheres to Kenyan consumer protection rules and does not engage in misleading advertising or making false product claims. We are committed to honest representation and responsible marketing practices.

Dispute Resolution

If you have any concerns regarding your order or delivery, our support team is available to assist. Where a matter cannot be resolved directly, you may seek further redress in accordance with Kenyan consumer protection frameworks or recognized dispute resolution channels.

Intellectual Property

All content on Finechef, including product images, photographs, videos, descriptions, graphics, icons, logos, brand names, page layouts, and any digital material created by or for Finechef, is fully protected under Kenyan copyright and trademark laws.

You are strictly forbidden from:

  1. Downloading or saving any images or content from the site or app
  2. Copying or reusing product descriptions, images, or videos
  3. Republishing Finechef content online or offline
  4. Using our content to create competing listings or websites
  5. Scraping or extracting data from our website or app
  6. Modifying, editing, or altering any Finechef visual or written material
  7. Presenting Finechef content as your own in any form

Any unauthorized use of Finechef’s intellectual property will lead to immediate action, including account suspension, copyright complaints, takedown notices, legal proceedings, and claims for damages under the Copyright Act and Trade Marks Act. Finechef also protects and respects the intellectual property of all vendors and brand partners featured on our platform.

Limitation of Liability

While we work to provide a consistent and reliable service, Finechef is not responsible for:

  1. Courier delays or errors
  2. Vendor decisions
  3. Third-party service interruptions
  4. Indirect or consequential losses

This does not limit any rights you have under Kenyan consumer law.

Changes to Terms

Finechef may update these Terms from time to time to reflect changes in law, platform features, or business operations. Any updates will be posted on this page and will apply to continued use of the platform. These Terms and Conditions are governed by the legal standards applicable to our business and the services we provide.
